ARA San Juan Disaster in Argentina: Former Submarine Commander Convicted of Negligence

The Argentine Ministry of Justice announced a significant decision regarding the tragic event that resulted in the sinking of the ARA San Juan submarine and the loss of its 44 crew members in 2017. The court found retired Navy Captain Claudio Villamide, who was the commander of the Argentine Submarine Forces at the time of the submarine's sinking, guilty of negligence and failure to fulfill his duties as a public official. The judges of the Río Gallegos Federal Criminal Court in Santa Cruz province sentenced Villamide to a firm three-year suspended prison sentence. Although this decision prevents the convict from actually going to prison, it includes a ban from public office for six years. The reasoned content of the court's decision is scheduled to be announced on 21 August.

Another notable development during the hearing was regarding the fate of other high-ranking naval officers. Rear Admiral Luis Enrique López Mazzeo, who was tried alongside Villamide and held the highest operational rank at the time as the Commander of Naval Preparation and Education, was acquitted. Additionally, two captains named Hector Anibal Alonso and Hugo Miguel Correa were unanimously found not guilty by the court and released. While these officers stood out as the only military officials brought to justice, their acquittal partially disappointed the expectations of the families and the public. Villamide, who had the final word during the hearing before the verdict, argued that he was completely innocent and that the cause of the sinking was still not fully understood.

Following the verdict, Valeria Carreras, the victims' lawyer, stated that this ruling was a massive step towards achieving justice. Carreras emphasized that proving Villamide's guilt was of great importance, noting that the 44 deaths that occurred were entirely preventable. This ruling carried a strong message not only for this case but also for the Argentine Armed Forces and the state to pay more attention to the personnel who give their lives to protect their homeland. The absence of the crew members' families in the courtroom as a result of the hearing was seen as a reflection of the emotional difficulties experienced throughout the process. Carreras's statements received wide coverage in the national press and celebrated that at least a portion of the systematic errors behind the disaster had been punished.

The ARA San Juan disaster turned into an international crisis when the submarine suddenly disappeared from radar on 15 November 2017. The last signal from the vessel was recorded at 07.33 that morning, and no news was heard from the submarine afterward. The families of the 44 crew members had to wait for hours in uncertainty and intense agony for a full 366 days. Finally, on 17 November 2018, the submarine's wreckage was reached in the South Atlantic, 500 kilometers off the coast of Comodoro Rivadavia, at a depth of 870 meters below sea level. The wreckage found bitterly proved that the submarine imploded due to extreme pressure in the depths of the water and that all personnel lost their lives instantly.

The claims put forward by the prosecutors and the families in the case revealed the serious technical negligence underlying the disaster that befell the submarine. The findings obtained during the investigation process proved that the vessel actually set out on patrol duty without meeting the optimum conditions required to navigate safely. The submarine had a severe restriction that it could only dive to a depth of 100 meters because its tests were not completed following the previously conducted mid-life maintenance and repairs. Despite this, the personnel were deployed in dangerous waters far beyond these limitations without conducting proper risk analyses. The court decision went down in history as an unforgettable legal process in which the responsibility for the deaths that occurred as a result of these gross negligences was officially recorded, at least partially.
