Backlash from Artists in Brazil: Petition Campaign Against the Ban on Erotic Cultural Events

In the city of Balneário Camboriú, located in the state of Santa Catarina, Brazil, the arts community has launched a major mobilization against a new bill that bans events with erotic content in public cultural spaces. The bill, numbered 252/2025 and approved by the City Council on June 17, aims to restrict all performances and events that contain sexual content or are deemed contrary to family values. Local artists, cultural producers, and civil society organizations, who took action immediately after the bill's approval, described the situation as a clear attempt at censorship. Stating that their primary goal is to convince Mayor Juliana Pavan to veto the proposal, the group is planning various actions to bring the issue to the public's attention. Artists argue that if enacted, this law will deal a severe blow to the city's colorful and diverse cultural fabric.

The controversial bill was prepared by City Council Member Marcelo Achutti and was brought to the agenda following the repercussions of the Balneário Camboriú Burlesque Festival held in the previous term. The opening of the said festival was planned to take place at the city's Bruno Nitz Municipal Theater, but the municipal administration at the time attempted to prevent it. On the grounds that the theater is a public space and the event was organized within its legal rights, the court issued a ruling allowing the festival to proceed as planned. While this judicial decision is seen as an important precedent for artistic freedom, the introduction of the ban as a political response has sparked major public debate. As a result, the bill, which was accepted with 16 votes in favor and only 1 against, envisions the complete prohibition of events explicitly defined as erotic.

Under the new regulation, all performances containing sexual content, making erotic allusions, or deemed harmful to the cultural values and family morals adopted by the municipality are banned in public spaces affiliated with the city. The harsh backlash from the arts community focuses on the ambiguous and highly subjective definitions of the law. Critics believe that the use of relatively vague concepts such as morals and traditional values in legal texts will encourage arbitrariness. Furthermore, it is emphasized that the age classification system already existing within the scope of Brazilian federal laws is sufficient for regulating such content. Artists argue that with this step, the municipality is directly suspending the freedom of artistic expression, which is safeguarded by the federal constitution.

Luciano Estevão, an actor and one of the leading figures of the opposition movement, stated that Mayor Juliana Pavan has the authority to reject the bill and that they are making efforts to ensure she uses this power. Noting that they firmly consider the regulation unjust and unconstitutional, Estevão reminded that the Brazilian Constitution already prescribes an age-limitation system for content. Emphasizing that the city of Balneário Camboriú has a highly cosmopolitan structure and is a place where people from all over the world live together, the artist stated that such bans are contrary to the city's nature. According to him, fighting this kind of battle in a democratic society is an inevitable step in defending fundamental human rights. Similarly, theater actress Potyra Najara criticized the law's restrictive nature on artistic freedom, arguing that it punishes diversity and creativity.

The resistance initiated by the arts community is not limited to just a petition campaign; it also includes awareness-raising activities across the city. To draw public attention, plans are being made to prepare a manifesto of rejection, produce viral video content, and publish statements of condemnation by the Culture Council. The organizers hope to open the petition campaign to a broad segment of the public to demonstrate the power of democratic reaction. While the mayor's decision is expected to be announced in the coming days, the city has effectively become the center of a cultural and legal conflict. In Brazil, the boundaries of artistic content in public spaces and the future of freedom of expression are once again being questioned and debated through such local crises.
