Driver who caused his wife's death acquitted by court

A verdict has been reached in the case filed following the death of a young woman in a tragic traffic accident that occurred in the direction of Yozgat Boğazlıyan, Kayseri. In the incident that took place on 15 Ocak, the car driven by Ş.G. collided with a truck at Himmetdede Kavşağı. C.G., who was severely injured in the accident, was rushed to Kayseri Şehir Hastanesi. However, despite all medical interventions at the hospital, the young woman could not be saved and lost her life. Following the incident, a lawsuit was filed against the driver Ş.G. on charges of 'causing death or injury by negligence'.

The verdict hearing of the case took place with the participation of the non-detained defendant Ş.G. via the Audio and Visual Informatics System (SEGBİS). Making her defense before the judicial panel, Ş.G. stated that C.G., who lost her life, was his wife and that the complainant was his father-in-law. He stated that the incident was entirely an accident and that he did not intentionally commit any crime. Noting that their children were also in the vehicle at the time of the accident, the defendant explained that they were returning from the doctor with his family. In his defense, he shared striking details about the moment of the accident.

The defendant Ş.G. claimed that the main factor in the accident was a dense dust cloud. Stating that he could not see ahead and did not realize he had hit the truck until the dust cloud dissipated, he argued that the real fault lay with the person who caused the dust cloud. However, he also acknowledged that, according to traffic rules and the nature of the accident, he legally fell into a faulty position due to rear-ending the truck. Although this situation made his defense more difficult, he emphasized that he did not hide the facts and that the tragic incident happened in an instant.

The horrific accident did not only result in the loss of one family member's life, but also deeply wounded those left behind. Following the accident, the young woman C.G. fought for her life in the hospital for about a week. During this process, both Ş.G. and the children in the vehicle were treated for various bone fractures and injuries. The family's pain increased exponentially, both with the ache of physical wounds and the heavy burden of losing a loved one. This tragedy revealed how a family can be shattered in a matter of seconds.

The judicial panel made a significant decision after evaluating all the evidence, the defenses, and the dynamics of the incident. Taking into account that the defendant Ş.G. experienced an accident caused by seasonal conditions and external factors that closed the line of sight, the court ruled for his acquittal. In this incident, where the driver caused the death of his young wife, the scales of justice were shaped in accordance with the dust cloud claim in the defense and the external factors during the peak moment of the accident. This decision went down in history as a cautious and remarkable case, both in the local community where the incident occurred and in legal circles.
