Peru State Attorney General's Office Dismissed Amado Enco Due to 'Loss of Confidence'

The Peru State Attorney General's Office (PGE) terminated the appointment of lawyer Amado Daniel Enco Tirado, who served as a public attorney under the Comptroller General of the Republic. This significant administrative decision was made by the institution's Board of Directors on the grounds of 'loss of confidence' (pérdida de confianza). This decision, which was approved unanimously during an extraordinary meeting of the Board, was based on the relevant article of Decree Law No. 1326, which regulates the conditions for the dismissal of public attorneys. The dismissed attorney had been serving in this critical position since Ocak 2023. The aforementioned decree clearly establishes the legal framework regarding job security and dismissal processes of attorneys tasked with the legal representation of the state in Peru.

The official notification process was executed by being signed by the Chief State Attorney María Aurora Caruajulca Quispe. In order for the decision to become law and be implemented, it was ordered to be officially notified to both the lawyer himself and the Comptroller General of the Republic to which he was affiliated. Such administrative procedures are of great importance in demonstrating that inter-institutional correspondence and legal processes operate meticulously within the Peruvian judicial and administrative system. In this process approved by the competent authorities, the justifications for the decisions taken by the attorney general's office are also published in the official gazette or on relevant platforms along with their legal basis. Prior to his appointment to this position, Amado Enco had a remarkable career as a public prosecutor specializing in corruption crimes. In the past, representing the state, he handled numerous corruption cases involving former civil servants and high-ranking officials. He undertook significant responsibilities in protecting the state's rights in judicial processes and elucidating corruption offenses. For this reason, his dismissal caused a wide repercussion in Peru's legal and judicial circles. The termination of the duty of a figure who, due to his area of expertise, ensured the state's representation in its most sensitive cases, also brought about various discussions regarding intra-institutional dynamics.

Following the decision's reflection in the public, Amado Enco made statements regarding the matter through his social media account, evaluating his own departure process. Enco, sharing from the Twitter (X) platform, claimed that the dismissal process was actually a retaliation. According to his statement, this decision is aimed at punishing the prosecutors who raised their voices against the inadequate management of Chief State Attorney María Aurora Caruajulca and criticized the institution. Enco strongly criticized the management approach within the institution and attempted to draw attention to the oppressive environment over his colleagues. This outburst caused the internal problems and institutional disagreements within the Peruvian prosecutor system to surface.

Following this crisis, eyes have turned to the new reforms awaiting Peru's legal system and state defense mechanisms. In his statement, Amado Enco demanded that the new government to take office in the future intervene in the matter and that urgent steps be taken. He emphasized that functional autonomy must be ensured, especially for public attorneys to be able to work fully independently, free from administrative pressures. This demand has reignited the long-standing debates in Peru regarding judicial independence and the elimination of political influences from state institutions. How the government will respond to institutional reform expectations in the upcoming period has become a matter of great curiosity in terms of the country's legal stability.
