Harsh Criticism in ARA San Juan Trial: 'Judges Were Not Up to the Gravity of the Situation'

The judicial process of the tragedy that resulted in the sinking of the Argentine Navy's submarine ARA San Juan and the loss of 44 sailors' lives has become a major subject of debate following the verdicts delivered. Dr. Luis Tagliapietra, a family member of one of the deceased crew members who also participated in the case as an intervening lawyer, has heavily criticized the court's decisions. Speaking to a local radio program, Tagliapietra emphasized that the attitude displayed by the judges throughout the process and the decisions they made fell short of establishing justice. The lawyer claimed that the judicial panel failed to deliver the expected justice and that numerous legal anomalies occurred during the process. These statements reinforce the perception that following a traumatic military disaster, the accountability expected by the families and the public from the legal system was not fully achieved.

The conclusions reached by the court and the announced verdicts have been met with profound disappointment and anger by the victims' relatives intervening in the case. Tagliapietra stated that the irregularities he observed from the very beginning of the process indicated they were already expecting this outcome, therefore the decision did not surprise them. In his criticism, built upon the judges' errors and flawed procedures, he explicitly argued that justice was not fully served. Pointing out that the decisions are directly linked to the anomalies previously identified in the case, the lawyer noted that the process should have been conducted in a much more transparent and fair manner. When evaluating the outcomes from the defendants' perspective, it is seen that the court acquitting most of the suspects has drawn a significant backlash. The acquittal of three of the defendants on all charges stands out as a detail that wounds the conscience of the victim's families and the public. Although one military personnel was found guilty regarding the incident, the sentence this individual received was seen almost as an example of impunity in terms of penal execution law. Despite the defendant being held responsible for breaching the obligations of public officials and causing the deaths of 44 people, they were only given a three-year suspended prison sentence. Tagliapietra noted that this is an extremely painful and lenient sanction for such a massive disaster that resulted in the loss of 44 lives.

One of the greatest difficulties experienced by the intervening victims' side was the obstacles they faced during the stages of evidence collection and witness questioning. Tagliapietra stated that the court restricted the victims' fundamental defense and questioning rights during the criminal process, which constituted constitutional rights violations. He claimed that even asking critical questions to some vital witnesses during the course of the trial was blocked by the judges. He noted that the approval of such restrictions and unjust demands by the court complicated the legal battle and showed that the judges failed to grasp the gravity of the event. The lawyer emphasized that due to these serious constitutional violations, they continuously filed objections throughout the process and will continue to seek their legal rights on every platform.

The signals that this legal crisis and victimization will not be abandoned are clarified by the future plans of the lawyer representing the case. Following the courts' winter recess, specifically after the month of Ağustos, it is planned to take new and critical legal steps in the process. Tagliapietra stated that on 21 Ağustos, the court will present the rationale and detailed explanation of the decision, and that these texts will be very important for the higher courts. Reminding that decisions were always made by majority vote and that there was a dissenting vote within the panel, the lawyer anticipated that these detailed dissident votes would form the basis of future appeal processes. Accordingly, the detailed examination of the reasoned decision and the analysis of the dissenting opinions will shape the next stage of the legal struggle for the victims' families.
