Order for Former 46 Malaysia Police Chief to Enter Defense on Bribery Charges

The Court located in Kuantan, Malaysia, decided to call former Temerloh District Police Chief Mohd Azhar Mohd Yusoff to court to enter his defense against a total of 46 bribery charges. The charges in question allege that he accepted bribes amounting to a total of 69.600 Malezya Ringiti (RM) between 2019 and 2023. Judge Sazlina Safie ruled that the prosecution had presented strong evidence against the defendant following the conclusion of their case. The 56-year-old Mohd Azhar must present evidence in his favor and make his defense after this stage of the legal process. The court stated that both the main charges and the alternative charges are legally valid and were prepared in accordance with the law.

While announcing the court's decision, it was emphasized that the charges do not violate Section 164 of the Criminal Procedure Code or Section 8 of the Federal Constitution. Judge Sazlina stated that the prosecution presented strong evidence for all 46 main charges the defendant faces under Section 165 of the Criminal Code. Furthermore, the court ruled that the legal presumption determined under Section 53 of the 2009 Malaysian Anti-Corruption Commission (MACC) Act is applicable to the defendant. This legal presumption strengthens the prosecution's hand by imposing on the suspect the burden of proving the legitimate source of their assets in bribery offenses. In this context, the judge decided that the defendant must personally present his defense for all charges.

It is known that the former police chief declared his innocence against these 46 charges on 7 Eylül 2023. According to the allegations, payments ranging from 100 RM to 5.600 RM were made to him. It is claimed that this money was transferred online to his bank account by various individuals and companies connected to his official duties. Mohd Azhar is alleged to have committed these crimes during his tenure as the Temerloh district police chief between Mart 2019 and Ocak 2023. This situation has brought issues of trust and transparency within law enforcement to the agenda and caused a huge public outcry.

For the cases at the defense stage, the court has set a new hearing date for 19 Ağustos. On this date, Mohd Azhar is expected to testify under oath from the witness stand and personally respond to the allegations against him. This stage represents a critical phase where the defendant can present witnesses on his behalf and submit evidence in his favor. The case serves as an example demonstrating how seriously public officials face trials against corruption charges. Throughout the process, the parties are expected to present their legal arguments in detail, and the court is expected to carefully evaluate all evidence.
