Man Who Severely Injured Friend with a Butcher's Knife While Drunk Acquitted Without Criminal Responsibility

In Charleville-Mézières, France, a 54-year-old man was tried on 5 Nisan for severely injuring his friend with a butcher's knife during an argument while intoxicated. Throughout the court process, the defendant's actions were examined in detail. On the date of the incident, police and fire brigade teams were called to the defendant's house. In his defense, the defendant stated that he drank three beers to relieve stress while his mother was on her deathbed, and that he did not remember what happened afterwards. The claim of the former soldier that he experienced "flashbacks" (sudden and disturbing memories) due to various wars he participated in the past moved the case to a different dimension. In his statement before the judge, the defendant stated that he completely forgot what happened after entering the house that day, noticing only the blood stains on his hands and seeing his friend lying in a pool of blood when he turned around. In a previous hearing, the court insisted on a psychiatric expert examination. The report prepared after a detailed examination and evaluation conducted by an expert psychiatrist became the most critical evidence determining the fate of the case. The report found that the defendant did not have any chronic mental illness, but exhibited dissociative (loss of consciousness and detachment) symptoms as a result of severe military-origin trauma. The expert reported that at the time of the incident, the defendant was unaware of his actions, felt as if he was outside his own body, and completely lost his sense of reality. Furthermore, it was emphasized that the defendant did not possess a dangerous profile in terms of criminological propensity to commit crimes.

The defendant stated in court that he wanted to go to a healthcare facility called "Bélair" for the treatment of his traumatic stress disorder (PTSD), but stated that his previous applications only resulted in alcoholism treatment, leaving his main problem unresolved. The prosecutor, acknowledging that the case presented an extremely complex situation, confirmed that based on the psychiatric report, the defendant had no criminal responsibility due to the complete loss of his decision-making capacity during the act. Consequently, the court requested compulsory hospitalization for the defendant instead of imprisonment. However, the court president announced that the defendant would not be sent to this facility by a judicial order, stating that he could seek treatment voluntarily. As a result, although the court acknowledged that the defendant indeed committed the violent acts and found the situation extremely serious, it ruled him "not criminally responsible" in light of the psychiatric report.
