Diving Instructor Charged with Culpable Homicide in Argentina

Following the death of young diver Sofía Devries during a deep-water diving event in Puerto Madryn, Chubut eyleti, Argentina, an official investigation process was initiated. The group's target was the wreck of the Hu Shun Yu, a vessel scuttled about ten years ago to create an artificial reef, which has since become one of the region's most popular diving spots. However, shortly after the dive began, underwater visibility dropped to extremely low levels. These poor visibility conditions severely hindered the instructor's ability to directly supervise all group members during the descent and bottom phases. Consequently, safety standards were placed at immense risk as the divers struggled to see each other and the instructor.

Despite the poor visibility conditions and increased risk factors, a fatal negligence unfortunately occurred, and the course of the incident reached tragic proportions. According to the prosecution's preliminary investigation hypothesis, 23-year-old Sofía Devries and her dive buddy became completely detached from the instructor's direct supervision during critical moments of the dive. Left alone, the young woman suddenly began to show signs of distress underwater and abruptly pulled the air regulator from her mouth. While her buddy tried to help her, Devries's oxygen supply was completely cut off during the complex and panic-filled moments. As a result of this chain of events, the young diver tragically lost her life by drowning. Following this terrible disaster, an extensive and intensive search effort was launched to recover the young woman's body. After approximately two days of uninterrupted search efforts, sailors finally reached her remains.

The prosecution argues in its ongoing investigation that the instructor's actions are incompatible with professional responsibilities. Authorities firmly emphasized that Pocovi's attitude violated the strict safety protocols and norms regulating professional diving activities. In this context, the suspect's actions were evaluated within the scope of Article 84 of the Argentine Penal Code and provisionally classified as the crime of culpable homicide. This legal provision subjects to criminal sanctions the act of causing the death of a person as a result of recklessness, incompetence, negligence, or failure to fulfill required duty of care. This legal framework forms the main basis that will bring the degree to which the instructor negligently breached professional standards before the judiciary.

Along with this final decision made by the judge, the judicial authorities have officially entered the evidence-gathering phase aimed at elucidating the incident. In the upcoming process, the Prosecutor's Office will thoroughly examine the evidence and, if sufficient elements are found, may request that the case be brought to a final trial, namely an oral hearing. Accordingly, expert reports regarding the technical failures experienced during the dive, the statements of other divers who witnessed the incident, and various forensic findings will be evaluated one by one. Furthermore, the extent to which the safety protocols in both recreational and professional diving rules were implemented, as well as the instructor's specific role in the dive that caused the disaster, will be thoroughly examined. These step-by-step judicial actions aim to strengthen the legal groundwork that will ensure the victim's family finds justice and prevent similar deaths in the future.
